Stellenbosch Yoga offers all the information, tools and services available on this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our website and/or purchasing products from us, you engage in our “service” and agree to be bound by the following terms and conditions (“terms of service”, “terms”), including those additional terms, conditions and policies referenced herein and/or available by hyperlink.
These terms of service apply to all users of the website, including users who are browsers, vendors, customers, merchants and/or contributors of content.
Please read these terms of service carefully before accessing or using our website or studio. By accessing or using any part of the website, you agree to be bound by these terms of service.
Any new features or tools that are added to the current website shall also be subject to the terms of service. You can review the most current version of the terms of service at any time on this page.
We reserve the right to update, change or replace any part of these terms of service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website or studio following the posting of any changes constitutes acceptance of those changes.
Section 1 – General
We reserve the right to refuse service to anyone for any reason at any time.
All purchases are final, non-refundable and non-transferable. Yoga packs and memberships may not be shared.
All practitioners must have a unique online account associated with a unique email address. Friends and family members may not share the same email address.
Every effort will be made to host classes on time. Please check the online schedule for the most up-to-date class times.
In attending classes at Stellenbosch Yoga, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Stellenbosch Yoga or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
It is the responsibility of the student to notify teachers of any previous injury, illness or conditions that may impact their practice.
Section 2 – Details around information
We don’t take responsibility if information made available on this website isn’t accurate, complete or current. The material on this website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
Any reliance on the material on this website is at your own risk. You agree that it is your responsibility to monitor changes to our website.
Section 3 – Prices and memberships
Prices for our products and rates for our services are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the service.
To attend any class, a booking and full advance payment must be made. This is non-negotiable.
Note, also, that membership is non-transferable and that payments for memberships and classes are non-refundable, unless otherwise stated in these Terms and Conditions. If a refund is approved at the manager’s discretion, an admin fee of R300 will be applied.
A member can only freeze a series of classes due to medical reasons with conclusive documentation provided from a medical specialist.
A member cannot cancel a series of classes once one class has been attended in the series and payment has already been made.
All classes to be paid by using SnapScan or by arrangement via cash only.
Any member who purchases a ‘three-month unlimited class’ package is entitled to participate in an unlimited number of classes for the set period as per the package at the studio while following the class booking process. The package is not transferable.
Any member who purchases a ‘monthly unlimited class’ package is entitled to participate in an unlimited number of classes for the set period as per package at the studio while following the class booking process. The package is not transferable.
Any member who purchases a ’10-class’ package is entitled to participate in 10 classes over a two-month period as per the package at the studio while following the class booking process. The package is not transferable.
Class package fees must be paid in accordance with these Terms and Conditions, irrespective of whether or not the member uses the studio's facilities.
Section 4 – Products and Services (Where applicable)
Certain products or services may be available exclusively online, through the website. These products or services may have limited quantities and are subject to return or exchange only according the items spesific return policies as stated at purchase.
We have made every effort to display as accurately as possible the colours and images of our products. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.
All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of the studio. We reserve the right to discontinue any product at any time.
Any offer for any product or service made on this website is void where prohibited. We don’t warrant that the quality of any products, services, information or other material purchased or obtained by our customers will meet their expectations, or that any errors in the service will be corrected.
Section 5 – Third party links
Certain content, products and services available via our website may include materials from third parties. Third-party links on this website may direct you to third-party websites that are not affiliated with us.
We are not responsible for examining or evaluating the content or accuracy and we don’t warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third-party websites.
Section 6 – Personal Information
Your submission of personal information through the website will not be used for unauthorised reasons.
Section 7 – Prohibited Uses
In addition to other prohibitions as set forth in the terms of service, you are prohibited from using the website or its content for any purpose other than the intended.
Section 22 – Bookings and Cancellations
A member may only book or reschedule sessions for themselves via the designated WhatsApp number provided on the website.
Due to small class sizes, members will be charged for sessions where cancellation or the rescheduling of sessions aren’t made using the designated WhatsApp number at least 24 hours prior to the booked time.
Sessions are booked on a first-come-first-served basis. A member may request to be added to the waiting list in the event that his first-choice session is unavailable. If a member joins the waiting list for a particular session and then books that session, his booking will be subject to the booking and cancellations policy in the usual way.
Late cancellations will be classed as a 'no show' and will incur the following:
Class member: Three or more late cancellations/no shows on the member’s account in one month will result in the suspension of the member’s class-booking privileges for one month starting from the date of the third no show.
Class package members: Late cancellations/no shows will result in the deduction of the class from the package.
All members are required to sign in to their booked class at least 5 minutes before its start time. Failure to do this will be treated as a 'no show'.
The booking and cancellation policy applies to all members.
In order to book a private session, full payment must be received in advance.
48 hours’ notice of cancellation is required, using the designated WhatsApp number.
Private classes bought in blocks/bulk with a discount applied will expire within 3 months of purchase.
Any private class cancellations outside the 48-hour cancellation window will incur a full charge for the class, or a session will be deducted from the bulk block bought.
Private sessions held in a client’s home or outside the studio are the responsibility of the client. The client hereby agrees to provide a warm, safe, clean comfortable environment as well as mats and other equipment required for the class.
Section 8 – Disclaimer of Warranties and Limitation of Liability
The studio doesn’t guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We don’t warrant that the results that may be obtained from the use of our services will be accurate or reliable.
You agree that, from time to time, we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk.
The service and all products delivered to you are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.
In no instance shall Stellenbosch Yoga, our directors, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or products procured using the service, or for any other claim related in any way to your use of the service or any product including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content or product posted, transmitted or otherwise made available via the service, even if advised of their possibility.
It is the member’s responsibility to ensure that they’re capable of undergoing a routine of exercises provided by any programme that they follow or class that they attend. Members accept the risk of injury from performing exercises and are advised to consult with their doctor prior to beginning any programme or class.
The studio accepts no liability for loss or damage to property or injury of members on studio premises or outside the studio, except in so far as such loss, damage or injury is by law incapable of exclusion.
Section 14 – Indemnification
You agree to indemnify, defend and hold harmless Stellenbosch Yoga and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these terms of service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
Section 44 – Use of Facilities and Attire Yoga Studio
Details of session times at the studio may vary from time to time. Session times will be published by the studio and will be available either at the studio or on this website. The studio reserves the right to make changes to the schedule at its discretion. The studio reserves the right to vary, adapt or amend the yoga series offered at the studio at its sole discretion.
A member is entitled to use the studio's facilities provided that the studio may at any time, without notice, withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the studio.
No person under the age of 18 may use the studio and attend classes.
Separate classes for under 18s may be scheduled in due course. Children must always be accompanied by an adult.
The studio is a cellphone-free zone. Ignoring this policy may result in class dismissal.
Members are requested to wear a form of dress appropriate to the practice of yoga.
Members should attend sessions barefoot. Footwear should be removed before entry into the studio. Verrucae or warts must be covered (use socks and/or bandages).
Members should use yoga mats to practice in the studio and are encouraged to use a towel or yoga sheet.
Mats are available to hire or may be purchased. The studio accepts no responsibility for the condition or the availability of the provided mats.
Personal belongings are brought onto the studio premises at the member's own risk. The studio doesn’t accept liability for any loss or damage whatsoever to such items.
In the interests of safety and hygiene, no crockery, glass or food are permitted in the studio. Only water is permitted.
Members must use the main entrance to the studio when entering or leaving. In the event of a fire, members are asked to make their way to the nearest available exit.
Smoking is forbidden in the studio.
Attendance of a class is always subject to the studio operating at a safe capacity. Entry to class is on a first-come-first-served basis.
Section 16 – Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These terms of service are effective unless and until terminated by either you or us.
You may terminate these terms of service at any time by notifying us that you no longer wish to use our services, or when you cease using our website.
If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these terms of service, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination. We may accordingly deny you access to our services (or any part thereof).
Section 333 – Health Warranty
Members are advised not to undertake yoga or other activities offered at the studio without first seeking medical advice if they have concerns over their physical condition. The studio reserves the right to refuse access to any member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of the facilities.
Members with low/high blood pressure and/or cardiac irregularities, detached retina, HIV, or those who are very overweight, underweight or pregnant, should not attend class until they have written permission from their doctor. If there is any doubt, the member should consult his or her doctor.
Members must notify the studio of any circumstances affecting their health that may be exacerbated through use of the studio.
Members are required to follow the instructions of the instructor at all times.
Members acknowledge that the participation in physical exercise and yoga classes naturally involve the risk of injury. Members must further acknowledge that specific risks include injuries resulting from overexertion, physical adjustment, improper or negligent use of recommended equipment (e.g. blocks and/or straps), failure to follow the trainer’s instructions, or injuries resulting from participation in an inappropriate level of physical exercise.
As such, members understand and voluntarily accept these risks and agree that they’re solely responsible for selecting classes and activities that are appropriate for their skill and ability level.
Section 20 – Intellectual Property
Members hereby acknowledge the following proprietary notices and legends: elements of the website are protected by copyright, trademark and other intellectual and industrial property laws, and may not be copied or imitated in whole or in part except as provided in this agreement.
No logo, graphic, sound or image from the website may be copied or retransmitted unless expressly permitted by Stellenbosch Yoga.
Any marketing, educational or other materials of this nature whatsoever produced by the studio, and which are made available to members, will at all times remain the property of the studio and will be subject to the company’s copyright.
